Ethics and Codes of Ethics for Judges and Prosecutors
In order to strengthen the professional conduct and integrity of judges and prosecutors, activities are ongoing to monitor the implementation of judicial and prosecutorial codes of ethics, regulations on preventing conflicts of interest in the judiciary, and the adoption and adherence to integrity plans of the courts and prosecutor's offices, focused not only on the professionalism and ethics of judges and prosecutors but also on upholding their integrity as judicial office holders.
The key institutions responsible for ensuring that the judiciary in Bosnia and Herzegovina operates in accordance with the highest ethical standards are the High Judicial and Prosecutorial Council of Bosnia and Herzegovina and the Office of the Disciplinary Counsel of the High Judicial and Prosecutorial Council of Bosnia and Herzegovina, as well as the judicial and prosecutorial training centres in the Federation of Bosnia and Herzegovina and Republika Srpska.
The High Judicial and Prosecutorial Council of Bosnia and Herzegovina defines the ethical standards that are mandatory for judicial office holders. These standards are found in the Law on the High Judicial and Prosecutorial Council of Bosnia and Herzegovina, as well as in the codes of ethics for judges and prosecutors, and other documents for implementation and enforcement, such as the Guidelines for the Prevention of Conflict of Interest in the Judiciary of Bosnia and Herzegovina.
The High Judicial and Prosecutorial Council of Bosnia and Herzegovina exercises its authority in this area through the Standing Committee for Ethics, Integrity and the Liability of Judges and Prosecutors, which is responsible for monitoring the implementation of these regulations with reference to judicial ethics, independence of the judiciary and the compatibility of carrying out other functions or activities and judicial office.
The codes of judicial and prosecutorial ethics serve to remind judicial office holders of the key principles of judicial ethics and to guide them on how to apply them in practice. They also provide the necessary information to help judges and prosecutors make the right decisions in everyday situations and when faced with various ethical challenges.
As for additional activities that judges and prosecutors can carry out and receive remuneration, permitted activities include providing training services in the field of law, writing papers, and membership in committees on the judiciary, such as committees for taking the bar exam etc.
